• Application Store means the Apple App Store or Google Play Store.

• Account means a unique account created for You to access the Service.

• Content means any text, images, videos, or other material submitted or displayed through the Service.

• Device means any device capable of accessing the Service.

• Feedback means feedback, ideas, or suggestions regarding the Service.

• Promotions refer to user-created contests or challenges offered through the Service, which may or may not include prizes, as described in the applicable Contest details.

• Service refers to the Application.

• Terms mean these Terms and Conditions.

• Third-Party Social Media Service means any third-party services or content made available through the Service.

• You means the individual or legal entity accessing or using the Service.

 

Acknowledgment

 

These Terms govern Your use of the Service and operate between You and the Company.

 

By accessing or using the Service, You agree to be bound by these Terms. If You do not agree, You may not access or use the Service.

Eligibility and Age Requirements

You retain ownership of Your Content.

 

You represent that You have all necessary rights to submit the Content and that doing so does not violate any third-party rights.

 

Content Restrictions

 

You may not submit Content that is unlawful, abusive, defamatory, discriminatory, deceptive, malicious, infringing, impersonating, or otherwise objectionable, including attempts to solicit payments, personal data, or off-platform engagement.

 

The Company reserves the right to remove Content or restrict access to the Service for violations of these Terms.

 

Content Backups

 

While backups may be performed, the Company does not guarantee against loss or corruption of Content. You are responsible for maintaining copies of Your Content.

 

Copyright Policy (DMCA)

 

The Company respects intellectual property rights and responds to valid infringement notices.

DMCA notices should be sent to DMCA@onsoco.com and must include all information required under 17 U.S.C. §512(c)(3).

 

Intellectual Property

 

The Service and its original content (excluding user Content) are the exclusive property of the Company and its licensors and are protected by applicable laws.

 

Feedback

 

You assign all rights to Feedback You provide. If such assignment is unenforceable, You grant the Company a perpetual, royalty-free license to use the Feedback without restriction.

The Company is not responsible for third-party websites or services linked through the Service. Use of third-party services is at Your own risk.

 

Termination

 

The Company may suspend or terminate Your Account at any time for violations of these Terms.

 

Upon termination, Your right to use the Service will immediately cease.

 

Limitation of Liability

 

To the maximum extent permitted by law, the Company’s total liability shall be limited to the amount paid by You through the Service, if any, or USD $100, whichever is greater.

 

The Company shall not be liable for indirect, incidental, or consequential damages.

 

“AS IS” Disclaimer

 

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, to the fullest extent permitted by law.

 

Governing Law

 

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules.

You agree to attempt to resolve disputes informally by contacting the Company before pursuing formal legal action.

 

United States Legal Compliance

 

You represent that You are not subject to U.S. sanctions or restricted-party lists.

 

Severability and Waiver

 

If any provision is held unenforceable, the remaining provisions remain in effect.

 

Translation Interpretation

The English version of these Terms controls in the event of any conflict.

 

Changes to These Terms

 

The Company may update these Terms with reasonable notice. Continued use constitutes acceptance.

 

Entire Agreement and Relationship to EULA

 

These Terms govern user conduct and participation in the Service. The End-User License Agreement governs licensing and use of the Application. In the event of a conflict, each document controls its respective subject matter.
